    Discussing in detail, the Rajasthan High Court is hearing a petition filed by the woman’s brother Chirag Singhvi who claims that his sister Payal Singhvi (now known as Aarifa) was forcefully converted to Islam and her marriage papers are forged.

    The bench of Justices Gopal Krishna Vyas and Manoj Kumar Garg, who are hearing the petition, have directed the police to register an FIR and investigate the matter. Besides, the state government has been asked if there is any law in the state governing religious conversions, to which government is expected to respond within 4 days. The next hearing date of the case is November 7.

    As of now, the woman has been sent to Nari Niketan for a week, and till then neither of the party shall be allowed to meet her. Till the case is resolved, the court has directed the state government to provide all facilities to the woman and “adequate security” to Faiz Modi’s family.

    According to the petitioner, the nikahnama was dated April 14; however, her sister was still living with her family until October 25, when she abruptly left the house.

    After leaving the house, the woman had sent an application to the Commissioner of Police, Jodhpur metro, stating that after her conversion to Islam, “her marriage has been solemnized with Faiz Modi as per Muslim customs”.

    Not only there isn’t any law that legalizes this conversion but the woman’s family is also stating that she has been abducted by Faiz Modi who is also blackmailing her.

    As of now, after HC’s orders, the police have lodged an FIR against Faiz Modi under Sections 366, 342, and 384 of IPC for the charges of abduction, extortion, forceful marriage, etc.

    This case has a strong resemblance to the ‘love jihad’ case of Kerala that had created a lot of controversy across the country. In May 2017, the Kerala High Court had annulled the marriage of a Hindu girl Hadiya who had converted to Islam to marry a Muslim man named Shefin Jahan. The girl’s father had allegedly claimed that her marriage was a part of a big racket of terrorist operatives’ recruitment.
